The Will of James A. Haviland

I, James A. Haviland of the County of Harrison, State of Kentucky being of sound mind and disposing memory do make this my last will and testament.

1st I direct that my Executors pay and satisfy any debts I may owe including my funeral expenses.

2 I will and bequeath to my brother Wm. S. Haviland thirteen hundred dollars.

3 I will and bequeath to my brother H. H. Haviland eighteen hundred dollars.

4 I bequeath to my sister Malinda J. Poindexter the sum of fourteen hundred dollars.

5 I will to my sister Martha J. Hamilton the sum of thirteen hundred dollars.

6 I will to my niece Margaret L. Stout daughter of my sister Mary White dec’d the sum of eight hundred dollars.

7 I will and bequeath to my sister Margaret M. Conway the sum of eight hundred dollars to be held by W. S. Haviland in trust for her and in order to better carry out my desires I direct that he invest the said sum or so much as he may think best in a house and lot in Cynthiana Ky to be used by her during her life such held by him in trust for her upon her death then the same is to go to her children equally.

8 I also will and bequeath to Mrs Sandy wife of George Sandy Esq the sum of one hundred dollars which I give her for her kindness to me while living at her house.

9 I also will and direct that after the payment of the aforesaid amounts to the aforesaid legatees and also my debts and funeral expenses that the remainder of my property be divided and distributed to the Wm S. Haviland Henry H. Haviland Malinda J. Poindexter, Martha J. Hamilton Margaret L. Stout and Margaret M Conway Equally, the portion coming to the said Margaret Conway to be held by my brother Wm S. Haviland in trust for her for her benefit.

10 I nominate and appoint Wm S & H. H. Haviland as Executors of this my last will with the request that either of them may act should the other decline or think best that but one should act and I further request that no security be required when they or either of them shall qualify as Executor or Executors. I direct that my Executors use their best efforts to collect all that is due to my Estate and pay to the distributees and legatees under this my Will within two years after they qualify.

11 I further will and direct that my Executors are to make no charge for their services for acting as Executors of this Will and are not to receive any compensation therefor.

Harrison County Court April Term April 25th 1897

I, J. R. M. Callis Clerk of the Harrison County Court do Certify that the foregoing instrument of writing purporting to be the last will and testament of James A. Haviland deceased was produced in open Court at the March Term March 28th 1897 and proven by the oath of John M. Poindexter one of the subscribing witnesses thereto and at the above Term of Court proven by the deposition of J. R. Boyd the other subscribing witness to said writing whereupon said instrument of writing was established as and for the last will and testament of James A. Haviland deceased and ordered to be recorded as such Which is done this 1st day of May 1892.
