This Indenture made and entered into this thirty first day of October one thousand eight hundred and forty two between Robert S Haviland of the County of Harrison and State of Kentucky of the one part and William H Casey of the County of Pendleton and State aforesaid of the other part Witnesseth that the said Robert S Haviland for and in consideration of the sum of three hundred dollars to him in hand paid by the said William H Casey hath this day granted bargained and sold and by these presents doth grant bargain sell alien and convey unto him the said Casey all that tract or parcel of land situate lying and being in the said County of Pendleton on the waters of Main Licking River and Richland Creek being the same tract of land conveyed by Joseph Poston to the said Robert S Haviland etc by deed of Mortgage of record in the Clerk office of the Pendleton County Court and which deed of Mortgage was duly foreclosed by a decree of the Pendleton Circuit Court sitting in Chancery in pursuance of a bill filed for that purpose by the said Haviland to the said Joseph Poston and said tract of land was by said tract decreed and ordered to be sold and the said Robert S Haviland became the purchaser at Commissioners sale and the same was surveyed and layed off and conveyed to him by William C Naylor as Commissioner appointed for that purpose and said purchase and conveyance being approved and confirmed by said Court in Chancery aforesaid the said deed together with a plat of said land was ordered and admitted to record in the said Clerks office of the Pendleton County Court in Deed Book H page 165 and which tract of land is therein fully described and bounded as follows to wit Beginning at a stone in the bed of the land of the Browning heirs Sugar tree bears S 62 W 15 links marked thence with Browning line S 20 E 220 ½ poles to a sugar tree Cromming corner thence continuing with Browning line N 46 E 117 ½ poles to a stone thence N 52 E 50 poles to a white oak Hickory thence N 45 E 120 poles to a stone thence S 30 E 36 poles to a stone Browning corner the western boundary of said land thence bearing S 28 E 6 links thence N 36 E 65 poles to near a small white oak thence N 46 E 42 ½ poles to a red oak thence N 42 W 10 ½ poles to a stone in improved land thence S 78 W 64 poles to the beginning containing eighty four acres To have and to hold the above described tract of land unto him the said William H Casey and his heirs or assigns forever together with all and singular the appurtenances thereunto belonging and the said Robert S Haviland for himself his heirs executors or administrators the aforesaid tract of land unto him the said William H Casey his heirs or assigns will and doth by these presents forever warrant and defend against the claim or claims of all and every person claiming the same by through or under him and doth further covenant and agree with him the said William H Casey his heirs executors administrators or assigns to refund to him or them the purchase money or proportionately of said land or any portion thereof the taxes on each by a better or prior title In testimony whereof the said Robert S Haviland hath hereunto set his hand and seal the day and date first above written

Commonwealth of Kentucky Pendleton County set I Reuben McCarty Clerk of the County Court for the County aforesaid do certify that this deed from Robert S Haviland and Mary C Haviland his wife to William H Casey was acknowledged before me by the grantors in my office on the 6th day of March 1843 to be his act and deed and Mary C Haviland his wife being examined by me separate and apart from her said husband said on the first day of April 1843 she declared that she did freely and willingly seal and deliver the said writing and that she wishes not to retract it and acknowledged the said writing again known and explained to her to be her act and deed and freely relinquished to the said William N Carey all her right of dower in the premises conveyed in said deed and consented that the same might be recorded which together with this certificate hath been truly recorded in my office Given under my hand this 7th day of April A D 1843 R McCarty Clerk
