2 Tracts on Richland Creek

This Indenture made this 30th day of October in the year of our Lord one thousand eight hundred & forty one between Joseph King & Catherine his wife & William Arnold & Polly his wife all of the County of Harrison and Commonwealth of Kentucky of the One part and Robert S. Haviland of the County and Commonwealth aforesaid Witnesseth that the said Joseph King & Catherine his wife & William Arnold & Polly his wife for and in consideration of the sum of Three Hundred Dollars to them in hand paid by the said R. S. Haviland the receipt whereof they do hereby acknowledge and thereof acquit & forever discharge the said R. S. Haviland his heirs executors & administrators by these presents have granted bargained sold aliened released & confirmed & by these presents do grant bargain sell release & confirm unto the said R S Haviland & to his heirs & assigns their undivided interest & claim which they now or may hereafter have in & to two pieces or parcels of land situated & being in the County & Commonwealth aforesaid & on the waters of Richland Creek.

The One Containing One Hundred & seven Acres & bounded as follows Begining at a large Red Oak & two Sugar trees corner to R. S. Havilands land thence South 89 E 76 poles to the centre of Richland Creek & up said Creek S 23 E 32 poles to a buckeye & white hickory on an Island thence N 50 1/2 E 134 poles to a Hickory & two Sugar trees corner to said Haviland lane thence S 9 E 32 poles to two White Oaks thence S 9 E 140 poles to two dogwoods two ironwoods thence S 46 W 60 poles to a red Oak Dogwood & sugar tree saplin thence N 22 W 46 poles to a box Elder by the fork of said Creek & up the West fork as follows Viz N 56 W 37 poles to a beech & two Sugar trees by the head of a spring N 24 W 10 poles N 4 W 25 poles N 31 E 20 poles N 65 W 31 poles to two Sugar trees on the bank of said Creek thence S 45 N 47 poles to two Sugar trees & small blue ash thence N 60 poles to the begining

The other piece of land containing Twenty nine & one quarter acres & being between & adjoining the land of Thomas Gaines Isaac Small & the aforesaid described tract & being the same lot that was purchased from Thomas Pollard by George King decd & being part of the tract on which Margaret Marsh formerly resided the two aforesaid tracts of land being the same that the late George King decd occupied during his life time & was lawfully seized & died intestate having issue Joseph King Polly King & Richard King and to whom the aforesaid lands by the law of this Commonwealth did descend & come as heirs to the said George King decd & the said Joseph King married Catherine Roak & Polly King married William Arnold as aforesaid who do now hereby convey as aforesaid to R. S. Haviland

To have and to hold their undivided interest in the two parcels of land containing in all one hundred and thirty six Acres with hereditaments & premises hereby granted or mentioned or intended so to be with appurtenances unto the said R. S. Haviland his heirs & assigns to his or their only proper use benefit or behoof forever

Kentucky Harrison County to wit

Stephen B Curran and John R Whitehead two of the Commonwealths Justices of the Peace for said County do certify that Polly Arnold the wife of William Arnold and Catherine King the wife of Joseph King personally appeared before us and being examined privily & apart from their husbands as the law directs voluntarily relinquished their right of dower to the premises conveyed by this deed and the same is certified to the Clerk of the County Court of Harrison County for record where the premises lie Given under our hands & seals this

State of Kentucky Harrison County to wit I Thomas B Woodyard Clerk of the County Court for the County aforesaid do certify that this Deed from Joseph King & others to R S Haviland was produced to me in my office and on the 8th Nov 1841 John R Whitehead one of the subscribing witnesses thereto made oath that Joseph King Catherine his wife William Arnold & Polly his wife did in his presence acknowledge the same to be their act & deed for the purposes therein contained and on the 13th day of said month S Bluman the other subscribing witness came into my office and made oath to the same effect and the said deed was ordered to be recorded which together with the annexed certificate is accordingly done Given under my hand this
